Google Mistrial, Anyone?

It’s called “Google mistrial,” and it refers to the concern that jury pools can be contaminated with outside information available on the web. Some courts have modified their jury instructions to include prohibitions on web research evidence. A Manhattan federal judge has gone further, issuing a pledge that jurors must sign, promising not to consult online resources for information relating to the case they are involved in. It’s testament to the ubiquity – and the power – of web-enabled devices.

Yes, Virginia, There Are Alternatives to Social Business Applications (and You May Not Want to Go There)

Alternatives to social business applications are out there, and some of them apparently weren’t developed with corporate litigation concerns in mind – particularly considering the courts’ tendency to consider social content to be ESI. The online employee chat room service, OfficeLeaks is one such social site, but its numbers suggest that users may be skeptical of such services, and rightfully so.

You Had to Know This Was Coming: Social Media Background Checks

Organizations can now hire a third-party firm to conduct social media background checks on prospective employees. Search results reported to the client organization must comply with employment policies and practices promulgated by the Equal Employment Opportunity Commission, but deep web search technology provides the capability to turn up considerable information on individuals based on their online presence, and there is at least one firm providing such background search services, enabling employers to make better-informed hiring decisions, while also complying with employment regulations.
